An orphan well is an oil or gas well left unplugged with no financially responsible owner. When an operator goes bankrupt or walks away, the well becomes "orphaned" — no one is required to seal it.
Operators are legally required to seal wells at the end of their productive lives, but 160+ years of drilling history has left a massive backlog. Many were drilled before modern regulations, or transferred to increasingly insolvent operators who eventually disappeared.
The criteria: an unplugged well with no active production (typically 12+ months) and no responsible party on record.
Texas tracks these through the Railroad Commission, flagging wells with delinquent P-5 operator filings for more than 12 months.
The 2021 Infrastructure Investment and Jobs Act allocated $4.7 billion through the REGROW Act. By September 2025, over $1.5 billion had been distributed to 26 states. Kansas has nearly eliminated its entire inventory. More than 9,600 wells have been plugged nationally, cutting methane emissions by ~155,000 metric tons per year.
